The Chief Justice, Justice Paul Baffoe-Bonnie, has informed President John Dramani Mahama that petitions seeking the removal of the Electoral Commissioner, her Deputies, and the Special Prosecutor have not established a prima facie case to warrant further investigations.
The Presidency announced this on Wednesday in a statement signed by Spokesperson to the President and Minister for Government Communications, Felix Kwakye Ofosu.
According to the statement, President Mahama had on November 25, 2025, referred seven petitions seeking the removal of the Chairperson of the Electoral Commission and her Deputies, as well as three petitions for the removal of the Special Prosecutor, to the Chief Justice for determination.
The referral was made in accordance with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959).
By a letter dated January 26, 2026, the Chief Justice informed the President that no prima facie case has been established by the petitions to warrant any further investigations for the removal of the Electoral Commissioner, Deputy Commissioners, and the Special Prosecutor.
The petitions were filed by various individuals and groups following the December 2024 general elections.
Under the constitutional process, when petitions are filed for the removal of constitutional office holders such as the Electoral Commissioner or the Special Prosecutor, the President is required to refer them to the Chief Justice to determine whether they disclose a prima facie case before any further action can be taken.
